Terms & Conditions

  1. GENERAL
    1. Definitions:
      1. The “Company” signifies AcuVids and Chinese Medicine That Works, Ltd.
      2. The “Content” signifies any video, audio or written information to be included, displayed, stored or streamed on or from the Site.
      3. The “Author” signifies any individual or party who produces content to be displayed on AcuVids.com or related websites. If the Author is not the Company, the Author is acting as an Independent Contractor. The author reserves ownership of whatever Content he or she provides to the Company. In the case that the Author is not identical to the Company, the Author’s views and opinions, whether explicit or implicit, do not reflect those of the company, and vice versa. In the event that the Author and the Company are not identical, the Content in no way reflects the work, opinions or ideas of the Company.
      4. The “Customer” signifies any individual, company or entity who has purchased a monthly subscription, day pass, recorded seminar, webinar or other product from the Company.
      5. The “Site” signifies www.acuvids.com
      6. The “Product” signifies any service purchased by the Customer from AcuVids or Chinese Medicine That Works, Ltd. These services include, but are not limited to: monthly subscriptions (sold on the site as ‘memberships’), recorded seminars and live and recorded webinars.
      7. “For life” applies to purchases of ONLY full length recorded seminars, or live and recorded webinars, and is defined as access to that video content for the time the Company and Site are solvent and active.  “For life” does NOT apply to monthly subscriptions/memberships.
  2. SOLICITATION
    1. No solicitation at live seminars or on this website is allowed without express written consent from Chinese Medicine That Works, Ltd.
      1. This includes promotion of self or another business, event, or product, including handing out invitations to events or parties or product literature not associated with Chinese Medicine That Works, Ltd.  Violation will result in removal of the attendee(s) from the seminar, and being barred from any future live seminars, without refund for the seminar.
  3. SUBSCRIPTION/MEMBERSHIP , RECORDED SEMINARS, LIVE AND RECORDED WEBINAR, AND PURCHASE OVERVIEW
    1. Monthly subscriptions (memberships) listed on the website as ‘Practitioner’ grant access to the video clip portion of the site, and are valid for one month. At the end of the month, the subscription will automatically renew, unless canceled by the Customer. Subscriptions/memberships do NOT grant access to full length recorded seminars, nor do they grant access to live or recorded webinars.
    2. Access to recorded seminars/workshops will be through purchases for a term “for life” as defined above. During that term, the Customer will have access to the recorded seminar.
    3. Access to live webinars:  Customers who purchase live webinars will have access to the webinar while it is being streamed, unless otherwise agreed upon. Live seminars are not streamed through The Site, rather, upon purchase the Customer will be given a link to join the live webinar.  This link will be provided to the Customer prior to the scheduled date and time of the webinar.
    4. Recordings of live webinars and recorded webinars:
      1. Recordings of live webinars: Customers who purchase live webinars will have access to the recorded version of the webinar “for life” as defined above, provided they attended at least 50% of the live webinar.  If the customer does not participate in at least 50% of the live webinar, they will forfeit their access to the recorded version.
      2. Purchase of recorded webinars: Customers who purchase recorded webinars will have access to it “for life”, as defined above.
    5. NCCAOM PDA and other State CEU webinars:  Customers must fulfill all NCCAOM and State requirements before being awarded PDA’s or CEU’s.  There may be requirements in addition to those outlined here, and Customers should consult the NCCAOM or their State Board for that information.
      1. Live PDA/CEU webinars and seminars: Customers must attend the ENTIRE live seminar or webinar to be eligible to receive PDA’s or CEU’s.
      2. Recorded PDA/CEU webinars and seminars:  Customers must attend the ENTIRE recording, as well as complete and pass all coursework, worksheets, and quizzes at the end of the recorded webinar before being awarded any PDA or CEU’s.
  4. REFUNDS AND CANCELLATION
    1. Refunds for live seminars: There are no refunds for live seminars.  A credit towards a future CMTW seminar will be given.
    2. Refunds for recorded seminars and webinars:  Refunds for recorded seminars or webinars are subject to a $25.00 charge.  The amount refunded will be reduced by $25.00.
    3. Subscriptions:  If a customer who purchases a monthly subscription chooses to cancel his or her membership, his or her subscription will continue until the end of the one month period in which the membership is canceled. At the conclusion of that month, the Customer’s account will not be billed and his or her subscription will end. All purchases other than monthly subscriptions are final and access to the Product will automatically expire at the end of the predetermined time period relative to the particular purchase.
    4. All sales are final, unless the Company is unable to provide the Product to the Customer. If the Company is unable to provide the Service, the Customer may receive a refund commensurate with the cost of the service not provided.
  5. RENEWAL OF SUBSCRIPTIONS
    1. Monthly subscriptions automatically renew unless canceled by the Customer. Each month, funds will be debited from a credit or debit card, or bank account via Paypal or other online service.
  6. ELIGIBILITY
    1. In order to be eligible to purchase subscriptions or other products and services from the Company as they pertain to the Site, the Customer must be one or more of the following:
      1. A Medical Doctor or Osteopathic Physician who is currently licensed and in good standing or, having completed one of the aforementioned degrees, is currently completing a residency program in preparation for licensure as a physician.
      2. A Licensed Acupuncturist, Registered Acupuncturist, East Asian Medical Practitioner or holder of an equivalent license in the state, province, territory or country in which the Customer practices. To qualify for condition b, the Customer must be licensed and in good standing.
      3. The Customer must be currently enrolled as a student at an accredited institution, pursuing a course of study that will lead to licensure as an acupuncturist or physician, as defined in a and b of this section.
  7. COPYRIGHT
    1. No part of the Site or the content thereof may be copied, reproduced, imitated, displayed, stored, or transmitted without prior written permission from both the Company and the Author of the content. All content remains the property of the Author of that content.
  8. CONTENT FOR CUSTOMER ONLY
    1. The Content is intended for use by the Customer only. It is a violation of these Terms and Conditions for the Customer to share his or her login information with a third party. Doing so will result in the immediate termination of the Customer’s access to the Site and Content and legal action. In the aforementioned case, no refunds will be given.
  9. VIII. CONTENT FOR LICENSED PROFESSIONALS ONLY
    1. Content in this site is provided for educational purposes only for health professionals, and does not replace training at an accredited institution of higher learning,
  10. CONTENT DOES NOT REPLACE THE NEED FOR MEDICAL TREATMENT
    1. Content of this site has not been evaluated by the FDA. Content is not meant to diagnose or treat, nor does it replace the advice of a licensed physician, nor is it intended to be used as or substitute for medical advice.

*We reserve the right to add. remove, or otherwise change the content of this website (video clips, recorded seminars, webinars, etc.) at any time. We also reserve the right to change these Terms and Conditions at any time and at our discretion.

DISCLAIMER: NOTHING IN THIS PROVISION SHALL AFFECT OR LIMIT OUR LIABILITY FOR ARISING FROM OUR GROSS NEGLIGENCE NOR FOR LIABILITY FOR WILLFUL MISCONDUCT NOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER THE APPLICABLE LAW. THESE PROVISIONS DO NOT AFFECT ANY APPLICABLE STATUTORY RIGHTS
